Instalments
Whether payments continue to fall due depends on how the payment plan is structured. Milestone-linked plans and date-linked plans behave differently when a project stops. If you intend to withhold, state the position properly; silence is easily characterised as default.
Evidence gathering
Collect while the project is still visible.
- Dated site photographs and video
- Published progress information for the project
- Every communication about the stoppage and its expected duration
- Payment demands received during the period of inactivity
Group action and individual positions
Purchasers in the same project often pool evidence about progress and communications, which can be useful. Contractual positions are still assessed individually, because SPAs, payment histories and objectives differ between buyers.
