How they start

Usually with a request. The purchaser asks to exit and to have payments returned; the developer declines, or offers something else — a different unit, a revised plan, a partial credit. What happens next depends heavily on how the request was framed and on the purchaser’s own position under the contract.

Where purchasers lose ground

The same patterns appear across files.

• Requesting a refund on grounds that are not made out, which invites a refusal on the merits
• Allowing arrears to accumulate during the dispute
• Signing a settlement or addendum without understanding what it releases
• Corresponding at length without a strategy, and conceding points along the way
• Waiting until the project’s status has changed before taking advice

What strengthens a position

A clear grounds analysis based on the contract. Complete payment records. Contemporaneous evidence of what was promised and what happened. A consistent written position. And an objective stated at the outset, so that any offer received can be measured against it.

Settlement is a legitimate outcome

A commercially negotiated resolution is not a failure of the process. Whether an offer is worth taking depends on what the realistic alternative costs in time, money and risk — which is a calculation, not an instinct.
